Welcome to MyVocal AI.

Effective 5/14/2024, ProVisionary Intelligence Limited ("ProVis", "we", "our" or "us") has acquired MyVocal AI and will be the new owner and operator of the MyVocal AI service which specializes in producing synthetic voices using proprietary AI technologies. These Terms of Service ("Agreement") govern your access and use of our web platform, API, voice generator software-as-a-service, AI voice models, and related applications and services (collectively, the "Services").

1. Acceptance

By accessing or using the Services, you accept and agree to be bound by this Agreement and our Privacy Policy. If entering on behalf of a company or entity, you represent having authority to bind that entity.

2. Intellectual Property Rights

a. Your Content

You may provide audio files and voice data ("Content") for generating AI voice models ("AI Models") incorporating our technologies. By providing Content, you grant us a royalty-free license to use, modify and process it for such purposes. You warrant having necessary rights over the Content.

b. Our Materials

We or our licensors own all right, title and interest in the Services, AI Models, proprietary technologies and materials provided ("ProVis Materials"), protected by intellectual property laws. We grant you a limited, revocable, non-exclusive license to access ProVis Materials for using the Services per this Agreement.

c. Feedback

Any feedback you provide becomes our exclusive property and you assign all rights therein to us.

d. Data Retention

Upon termination, you may request destruction of AI Models and Content per our data practices. We retain rights in aggregated, anonymized metadata generated during the Services.

3. Accounts

You're responsible for maintaining confidentiality of any accounts created and all activities under your accounts.

4. Term and Renewal

The Agreement commences per your order and renews automatically for successive terms of the same duration unless cancelled by you.

5. Termination

We may terminate this Agreement with 30 days' notice or immediately if you materially breach the Agreement. We may modify or discontinue the Services at any time.

6. Acceptable Use

You won't use the Services to publish or make available any unlawful, infringing, abusive, hateful, discriminatory, or otherwise prohibited content or conduct activities restricted under this section.

7. Support

We'll provide commercially reasonable support services during stated business hours.

8. Warranties and Disclaimers

We'll use reasonable efforts to provide the Services, but make no guarantees that AI Models will be error-free or meet all requirements. The Services are provided "AS IS" without warranties of any kind.

9. Limitations of Liability

Our liability is limited and we disclaim indirect, special, consequential and certain other damages, as detailed in this section.

10. Legal Waivers

You waive rights to a jury trial and participation in class actions related to the Services.

11. Claim Time Limits

You agree not to bring any claim more than 12 months after it first arose.

12. Indemnification

You'll defend and indemnify us against third party claims and losses arising from your breach of this Agreement or unlawful use of the Services.

13. Miscellaneous

This Agreement shall be governed by the laws of Singapore. You may not assign the Agreement, but we may. This is the entire agreement between us for the Services.

  • Updating intellectual property provisions to cover ProVis materials and data practices
  • General updates to legal terms like limitations of liability and indemnification
